Unfortunately there is currently no official ruling on this so I'd say go send this to Bushiroad but from what I understand is if there is 8 cards left in deck, you check 8 cards, than return the rest to Deck.
** Note that in case you don't realize this, it's not a deck out, it's SHOWING.
You may choose not to believe me cause really that's what I sorta get from the effect.

You cant use it if he has less than 10. It's not a official ruling but i'm pretty sure you can't.

8.5.3.
If the card or ability has a text that says "choose (something)", then you make the choice when the effect resolves.
8.5.3.1.
If the number to choose is specified, then you need to make that many number of choices as much as possible. You cannot choose to not choose while it is possible for you to choose.
8.5.3.1.2.
If the number to choose is specified, but it is impossible to make that many choices, then you will make as many choices as possible, and apply the effects on them.
tl;dr
Check the top 8 cards if you can't check the top 10.
Another thing to take note is that even if they can't check the top cards, they can still pay the cost and get as much effect as they can with it. A good example is the CBD+Palladium combo where you activate Palladium's skill first to re-lock the opponent's RG and then you activate's CBD skill to draw a card but without the retire effect.
